PHC issues contempt warnings after KP minister stopped from boarding flight

PESHAWAR — The Peshawar High Court (PHC) has expressed severe dissatisfaction over the offloading of Khyber Pakhtunkhwa Higher Education and Youth Affairs Minister Meena Khan Afridi from a Germany-bound flight at Bacha Khan International Airport.

A single bench headed by Chief Justice Syed Muhammad Atique Shah heard the high-stakes proceedings. During the session, the bench directed the provincial minister to file a fresh legal petition to challenge newly surfaced travel bans. Additionally, the court initiated a separate contempt-of-court track against federal border control authorities for flouting explicit judicial clearances.

State Authorities Override Court Clearances via Secret Lists

The legal dispute escalated after airport immigration officials detained the provincial minister for over two hours. Consequently, the border security staff prevented him from boarding his flight despite a standing PHC order that permitted him to travel to Germany for official engagements.

Appearing before the bench alongside his counsel, Bashir Khan Wazir, minister Meena Khan Afridi detailed a systematic bureaucratic blockade.

“Unfortunately, I was not allowed to proceed. Airport authorities claimed that my name remains locked on the Provisional National Identification List (PNIL) and Passport Control List (PCL). They also informed me that my passport has been blocked. Shockingly, this listing was secretly updated on June 5—just after this court issued clear orders declaring my name clean on all other federal blacklists.” — KP Minister Meena Khan Afridi

In response, Chief Justice S.M. Atiq Shah questioned the Deputy Attorney General regarding the legal basis of the secondary list. The court noted that federal law enforcement previously testified that no other travel restrictions existed. The chief justice subsequently ordered the petitioner to submit an independent application to dismantle the newly appended listings, promising an expedited hearing.

Contempt of Court Action Initiated

The chief justice stated that the high court will independently pursue a contempt case against the federal departments responsible for bypassing judicial orders. He emphasized that the judiciary remains a relentless equalizer across the province.

Judicial-Executive Dialogue Shifts to Youth Brain Gain, IT, and AI Reforms

In an unusual turn during the hearing, the courtroom dialogue shifted into a broader conversation regarding regional economic flight, human capital preservation, and digital governance. Chief Justice S.M. Atiq Shah observed that industrial investors continue to migrate from Peshawar toward Islamabad and Lahore, noting that infrastructure like the motorway has ironically accelerated regional capital flight.

The chief justice stressed that the province must capitalize on its demographic reality, given that youth make up 64% of the provincial population. He referenced an earlier case where a local freelancer testified to earning Rs1 million monthly from home, highlighting that tech competence is the only viable solution to regional economic issues.

Minister Meena Khan Afridi defended his department’s performance, revealing that his trip to Germany was explicitly aimed at securing international tech partnerships. He outlined several ongoing provincial initiatives:

  • Advanced Academic Labs: The department has established specialized artificial intelligence (AI) and information technology (IT) laboratories across four major universities.
  • Frontier Infrastructure: A newly launched IT and AI laboratory has officially begun training students at a technical college in the tribal district of Khyber.
  • Sino-Pak Academic MoUs: The KP government has signed a Memorandum of Understanding with Chinese counterparts, enabling international students to learn advanced IT and AI skills at Gomal University.
  • Fiscal Integration: The provincial administration has formally allocated dedicated tech development funds within the upcoming fiscal budget to help local youth compete globally.

The court highly appreciated these academic milestones, urging the minister to scale up digital infrastructure. The PHC directed the legal team to submit the formal petition immediately, scheduling the follow-up enforcement hearing for tomorrow.
