PESHAWAR: The Peshawar High Court (PHC) sought an explanation regarding the Tirah Valley military operation. The court questioned whether the government had met the legal and constitutional requirements for the action.
A division bench of Justice Waqar Ahmad and Justice Muhammad Faheem Wali heard the petition. The case challenges the operation and the resulting displacement of local residents.
Petitioner’s counsel Barrister Saud Javed questioned the transparency of the operation during the proceedings.
“The government must clarify if the Assembly permitted the Tirah operation. If the Federal or Provincial governments passed a resolution, they should present it to the court,” Barrister Javed argued.
He also noted discrepancies in government communication. He alleged that federal officials give different statements in Parliament than they do in court.

Contradictory Stances from Government Officials
The hearing showed that neither government took ownership of the operation:
- Federal Government: The Additional Attorney General stated the Federal Government did not grant permission.
- Provincial Government: The Advocate General claimed the Provincial Government did not authorize the military action.

Relief for Tirah Affectees (IDPs)
The court expressed concern over the humanitarian situation. It directed authorities to release funds immediately for those the Tirah operation displaced.
“Authorities must issue funds to ensure displaced people do not face more hardships,” the bench remarked. The court also asked if provincial relief camps provide adequate assistance.

The Peshawar High Court issued the following directives:
- Notices Issued: The court sent formal notices to the Federal Government, Provincial Government and provincial disaster management authority.
- Secretary Relief Summoned: The Secretary of Relief must appear at the next hearing.
- Tribal Elders: Tribal leaders will present their grievances at the next session.
- Reporting Deadline: Both governments must submit reports on the operation and IDPs within one week.
The court adjourned the hearing until February 12, 2026.
